Please read these Terms and Conditions (“Terms”) carefully before using KozyOps (the “Software”) provided by Kozy Operations, LLC (“we,” “our,” or “us”). KozyOps is a product of Kozy Operations, LLC. By accessing or using the Software, you agree to be bound by these Terms and our Privacy Policy.
License Grant
We grant you a non-exclusive, non-transferable license to access and use the Software in accordance with these Terms. The Software is licensed, not sold, to you. You may use the Software solely for its intended purpose and in compliance with all applicable laws.
User Responsibilities
You agree to:
- Use the Software only for lawful purposes.
- Not use the Software to transmit harmful, offensive, or illegal content.
- Not reverse engineer, decompile, or disassemble the Software.
- Not sublicense, rent, lease, or distribute the Software to third parties.
Account Creation and Security
To use certain features of the Software, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use of your account.
SMS Messaging
The messaging program consists of general conversational messaging to answer questions and provide support to customers.
Sender Identification: Kozy Operations, LLC.
SMS Message Types: By opting in, you agree to receive SMS messages from KozyOps, including service updates, appointment notifications, account alerts, and customer support messages. Message frequency varies based on your interactions and service activity. Message and data rates may apply.
- Opt-Out: You can cancel the SMS service at any time. Just text ‘STOP’ to the phone number from which you received messages. After you send the SMS message ‘STOP’ to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
- If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at success@kozyops.com.
- Carriers are not liable for delayed or undelivered messages.
- As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency will vary based on communication needs. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Subscription and Payment
If the Software requires a subscription or purchase, you agree to pay all applicable fees. All payments are due in advance and are non-refundable unless stated otherwise. We reserve the right to change pricing at any time, with notice to you.
Updates and Modifications
We may provide updates, upgrades, or patches to the Software, which may include bug fixes or new features. You agree to install any updates as they become available. We reserve the right to modify or discontinue the Software at any time.
Intellectual Property
The Software, including all its content, design, code, and trademarks, is owned by KozyOps or its licensors. You acknowledge that you have no rights to the Software other than the license granted in these Terms.
Privacy
Our Privacy Policy explains how we collect, use, and protect your personal data. By using the Software, you agree to the collection and use of your data as described in the Privacy Policy.
Limitation of Liability
To the fullest extent permitted by law, KozyOps shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use the Software. Our total liability is limited to the amount you paid for the Software in the last 12 months.
Termination
We may suspend or terminate your access to the Software if you violate these Terms. You may also terminate your use of the Software at any time by discontinuing use and uninstalling the Software.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Connecticut. Any legal action or proceeding related to these Terms shall be brought in the courts located in Trumbull, Connecticut, or the appropriate court in Fairfield County, Connecticut.
Changes to Terms
We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page with an updated revision date. Your continued use of the Software after such changes constitutes your acceptance of the updated Terms.
